Terms of Use

1. ACCEPTANCE OF TERMS

By downloading or using QR & Barcode: Scanner, Creator (the "App"), you agree to these Terms of Use and our Privacy Policy. We provide this App to you subject to your compliance with these terms. If you do not agree, you must cease all use of the App immediately.

2. LICENSE & RESTRICTIONS

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You shall not:

• Decompile, reverse engineer, or attempt to derive the source code of the App.
• Use the App to create, store, or transmit infringing, libelous, or otherwise unlawful material.
• Bypass any measures we may use to prevent or restrict access to the App.

3. INTELLECTUAL PROPERTY

All rights, titles, and interests in the App (including but not limited to the QR generation engine, UI design, and branding) belong to HONGKONG SKYFORGE TECHNOLOGY LIMITED. No ownership rights are transferred to you by using the App.

4. SCANNING & SECURITY FEATURE DISCLAIMER (CRITICAL)

The App includes a feature designed to identify potential risks in scanned URLs by matching them against third-party databases or internal whitelists/blacklists.

• No Guarantee of Safety: This security scan is provided for informational purposes only. We do not guarantee that our App will detect all malicious websites, phishing attempts, or malware.
• User Responsibility: A "Safe" status does not mean a website is 100% secure, and a "Risk" status is based on automated technical signatures which may occasionally result in false positives.
• Third-Party Content: We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites accessed via scanned codes. You access them at your own risk.

5. USER-GENERATED CONTENT (QR CREATOR)

When you use the "Create" feature to generate codes:

• You are solely responsible for the content embedded in the QR code.
• You warrant that your generated codes do not violate any third-party intellectual property rights or local laws.
• We reserve the right to restrict features if we detect patterns of abuse or illegal activity.

6. INDEMNIFICATION (Legal Patch)

You agree to indemnify, defend, and hold harmless HONGKONG SKYFORGE TECHNOLOGY LIMITED and its officers from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the App.
• Your violation of any term of these Terms.
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right.

7. LIMITATION OF LIABILITY & "AS-IS" WARRANTY

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA OR FINANCIAL LOSS, RESULTING FROM THE USE OR INABILITY TO USE THE APP OR FROM SCANNING MALICIOUS THIRD-PARTY LINKS.

8. CLASS ACTION WAIVER (Major Legal Patch)

YOU AND THE COMPANY AGREE THAT ANY PROCEEDINGS TO RESOLVE OR LITIGATE ANY DISPUTE WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS. NEITHER YOU NOR THE COMPANY WILL SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, OR IN ANY OTHER PROCEEDING IN WHICH EITHER PARTY ACTS OR PROPOSES TO ACT IN A REPRESENTATIVE CAPACITY.

9. GOVERNING LAW & JURISDICTION

These Terms shall be governed by the laws of Hong Kong S.A.R. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

10. TERMINATION & MODIFICATIONS

We reserve the right to modify these terms or terminate your access to the App at any time without prior notice. Continued use of the App after changes constitutes acceptance of the revised Terms.

11. SUBSCRIPTIONS & BILLING

Certain features of the App may require a paid subscription. Subscription options and pricing will be displayed on the purchase screen before payment is completed.

• Payment will be charged to your Apple ID account upon confirmation of purchase or after any applicable free trial period.
• Subscriptions renew automatically unless auto-renewal is disabled at least 24 hours before the current billing period ends.
• Your account may be charged for renewal within 24 hours prior to the end of the active subscription period.
• You may manage or cancel subscriptions through your Apple ID account settings at any time. Removing the App does not automatically cancel an active subscription.
• Any unused portion of a free trial, if offered, will be forfeited once a subscription is purchased.
• Refund requests for subscriptions purchased via the Apple App Store must be submitted directly to Apple and are subject to Apple’s refund policies.
